The Ibero-American Conference is a forum for dialogue, consultation and cooperation in which the observance of human rights is an essential principle. These rights are an area of action of the Ibero-American system. The instruments adopted by the Conference and other Ibero-American instances provide political and legal indications in the field of human rights that must be developed through initiatives, actions, programmes and agendas of cooperation. Social rights deserve special attention at the Ibero-American Summits. All this should have an influence (...) on the positions of the Inter-American Court of Human Rights, particularly when it deals with cases in which are affected economic, social and cultural rights, as it has been done in the wake of recent judgments on the matter. The work of the Ibero-American system in the fields of migration and culture will be of particular interest to the Inter-American Court in determining the content and scope of the rights recognized and protected in the inter-American system. RESUMEN: La labor del Tribunal Penal Internacional para la Ex-Yugoslavia tuvo un momento importante en la compresión del principio de legalidad, como principio básico en la garantía de los derechos humanos, al enfrentar no sólo el derecho consuetudinario como fuente de derecho sino también diferentes modos o enfoques en la identificación de este derecho consuetudinario. Esta relación debe ser analizada a la luz de las limitaciones que tiene el derecho internacional y, sobre todo, de los procedimientos de creación de normas. (...) No resulta fácil exigir responsabilidad en el cumplimiento del derecho internacional humanitario y de los derechos humanos. La práctica de este Tribunal abre una vía para la reflexión con la finalidad de asegurar el respeto de los derechos humanos en cualquier circunstancia, incluso de aquellos que llevaron a cabo la comisión de graves crímenes contra la comunidad internacional.ABSTRACT: The work of the International Criminal Tribunal for the former Yugoslavia was important for understanding the principle of legality as a key principle on the guarantee of Human Rights. The former was due to the Tribunal’s work on having faced the customary law as a source of law using different perspectives for its identification. The link between customary law, principle of legality and human rights has to be analyzed taking in account the limits of International law and the procedures for creating legal norms. It is not easy to invoke responsibility in the fulfillment of international humanitarian law and international law of human rights. The practice developed by this Tribunal provides an avenue for thinking about ensuring the respect of the human rights in any case including the commission of grave crimes against international community. Los textos hipocráticos y su vigencia: elementos para la formación humanística del médico en el siglo XXI Os textos hipocráticos e sua validade: elementos para a formação humanística do médico no século XXI By way of notes, comments are made on the validity of some Hippocratic works from the perspective of the learning and practice of medicine in the first decades of the 21st century, amidst a expanding technical-scientific and computer civilization. The paper highlights the affirmation of perennial truths —valid (...) at all times— extracted from a selection of Hippocratic writings, which express the spirit of classic Greek medicine understood as tekhne iatrike. It was originally conceived as an activity of a rational, human, philanthropic and scientific nature aimed at serving the good of patients, following an ethos and some ethical principles and values of universal range, validity and application. It is proposed that taking in these concepts provides the medicine student with humanity, dignity, moral and intellectual growth, and improves their attitudes and aptitudes, skills and abilities to understand and face multiple existential situations that permeate daily clinical practice. This not only requires professional technical skills, but also humane attributes for better approaching interpersonal relationships with and attitudes towards the patient and their families. These ideas are introduced as a contribution of bioethics, characterized by its humanities-science-technology integration and educational mission of training critical consciences within the techno-scientific civilization, in order to foster respect for and openness towards diverse aspects of reality. The enactive approach to cognition distinctively emphasizes autonomy, adaptivity, agency, meaning, experience, and interaction. Taken together, these principles can provide the new sciences of language with a comprehensive philosophical framework: languaging as adaptive social sense-making. This is a refinement and advancement on Maturana’s idea of languaging as a manner of living. Overcoming limitations in Maturana’s initial formulation of languaging is one of three motivations for this paper. Another is to give a response to skeptics who challenge enactivism to connect “lower-level” (...) sense-making with “higher-order” sophisticated moves like those commonly ascribed to language. Our primary goal is to contribute a positive story developed from the enactive account of social cognition, participatory sense-making. This concept is put into play in two different philosophical models, which respectively chronicle the logical and ontogenetic development of languaging as a particular form of social agency. Languaging emerges from the interplay of coordination and exploration inherent in the primordial tensions of participatory sense-making between individual and interactive norms; it is a practice that transcends the self-other boundary and enables agents to regulate self and other as well as interaction couplings. Linguistic sense-makers are those who negotiate interactive and internalized ways of meta-regulating the moment-to-moment activities of living and cognizing. Sense-makers in enlanguaged environments incorporate sensitivities, roles, and powers into their unique yet intelligible linguistic bodies. We dissolve the problematic dichotomies of high/low, online/offline, and linguistic/nonlinguistic cognition, and we provide new boundary criteria for specifying languaging as a prevalent kind of human social sense-making. A widespread need to explain the behavior and outcomes of AI-based systems has emerged, due to their ubiquitous presence. Thus, providing renewed momentum to the relatively new research area of eXplainable AI (XAI). Nowadays, the importance of XAI lies in the fact that the increasing control transference to this kind of system for decision making -or, at least, its use for assisting executive stakeholders- already affects many sensitive realms (as in Politics, Social Sciences, or Law). The decision-making power handover to (...) opaque AI systems makes mandatory explaining those, primarily in application scenarios where the stakeholders are unaware of both the high technology applied and the basic principles governing the technological solutions. The issue should not be reduced to a merely technical problem; the explainer would be compelled to transmit richer knowledge about the system (including its role within the informational ecosystem where he/she works). To achieve such an aim, the explainer could exploit, if necessary, practices from other scientific and humanistic areas. The first aim of the paper is to emphasize and justify the need for a multidisciplinary approach that is beneficiated from part of the scientific and philosophical corpus on Explaining, underscoring the particular nuances of the issue within the field of Data Science. The second objective is to develop some arguments justifying the authors’ bet by a more relevant role of ideas inspired by, on the one hand, formal techniques from Knowledge Representation and Reasoning, and on the other hand, the modeling of human reasoning when facing the explanation. This way, explaining modeling practices would seek a sound balance between the pure technical justification and the explainer-explainee agreement. (shrink)

The article analyzes the definitions of the personnel motivation known in the literature. It also shows that all the definitions describe the personnel motivation as a continual and permanent process of forming and providing the incentives from the enterprise to its employees. This process is aimed to promote the employees to complete the tasks of the company. The questioning method was used to study the motivation factors of the employees of different ages at the certain enterprise. The necessity of consideration (...) of the age factor for improving the motivation system of the personnel at the enterprise was explained. The defects of the existing system at the enterprise were formulated. The recommendations for managers were made as follows: 1) to identify the goals of the company and to inform the employees about them; 2) to develop a system of key performance indicators of the efficiency of the company and to use them to measure the results of the activity of the enterprises, departments and each participant of the work process; 3) to use scientific methods to monitor the situation with the personnel at the enterprise; 4) to improve the reward system; 5) to have the wage and labor correlation criteria. Adam Ferguson’s imperial thought casts new light on the age-old republican dilemma of the tension between empire and liberty. Generations of republican writers had been haunted by this issue as the decline of Rome proved that imperial expansion would eventually ruin the liberty of a state. Many eighteenth-century Scottish thinkers regarded this as an insoluble conundrum and thus became critics of empire. Ferguson shared their basic views but, paradoxically, was still able to defend the British Empire in the debates over (...) the American Revolution. His argument effectively offered a viable solution to the republican dilemma, which distinguished him from his contemporaries. In light of this, I argue that political representation was the pivotal conception for Ferguson to make empire and liberty compatible. ArgumentThis paper analyzes the public fasts of two Italian “hunger artists,” Giovanni Succi and Stefano Merlatti, in Paris in 1886, and their ability to forego eating for a long period (thirty and fifty days respectively). Some contemporary witnesses described them as clever frauds, but others considered them to be interesting physiological anomalies. Controversies about their fasts entered academic circles, but they also spread throughout the urban public at different levels. First, Succi and Merlatti steered medical debates among physicians on the (...) “scientific” explanations of the limits of human resistance to inanition, and acted as ideal mediators for doctors’ professional interests. Second, they became useful tools for science popularizers in their attempt to gain authority in drawing the boundaries between “orthodox” and “heterodox” knowledge. Finally, in the 1880s, Succi and Merlatti’s contest, the controversy around the liquids they ingested, and their scientific supervision by medical doctors, all reinforced their own professional status as itinerant fasters in a golden decade for that kind of endeavor. For all those reasons, Succi and Merlatti can be viewed as useful, epistemologically-active charlatans. (shrink)

The paper explores Alonso de la Veracruz's theses on civil power, which sought to integrate the native inhabitants of the New World into the Spanish political community. These theses, which have usually been associated with F. de Vitoria and Spanish Thomism, have recently come to be considered part of a Novohispanic republicanism developed in the American periphery. The article seeks to show that the purpose of such theses was to apply a theory of natural rights that did not entail the political participation of the indigenous population, as well as to analyze Veracruz's position regarding cultural diversity and the war against the indigenous peoples. The most documented juridical studies about hispanic woman in the late Middle Ages, belong to three specialities: political law, civil or common law (matrimonial), and criminal law. It is in the sphere of matrimonial law where the influence of christian principles has been described as prominent, contributing to the juridical conjugal parity, thus recognizing woman a full civil capability.

This essay argues that according to feminist existential phenomenology, feminist pragmatism, and feminist genealogy, our embodied condition is an important starting place for ethical living due to the inevitable role that habits play in our conduct. In bodies, the phenomenon of habit uniquely holds together the ambiguities of freedom and determinism, transcendence and immanence, and stability and plasticity. Seeing habit formation as a matter of self-growth and social justice gives fresh opportunity for thinking of “assuming ambiguity” as a lifelong endeavor (...) made up of many small projects and practices of situated resistance to stagnation. Transcendence, understood as ameliorative transformation, is found in cultivating habits of learning from our bodily living. I articulate this argument via a reading of Simone de Beauvoir's The Coming of Age, John Dewey's Human Nature and Conduct, and Ladelle McWhorter's Bodies and Pleasures. I discuss two domains wherein the ethical significance of habit formation appears: cognitive psychological research on neural plasticity, and certain projects of self-cultivation that risk turning into overdetermining “cult of the self ” practices that close off possibilities for personal and collective transformation. The justification of democracy, while widely debated, is hindered by a sub-optimal conceptual framework. For a start, there is confusion about the basic terms in the discussion. Many theorists claim to support either the ‘intrinsic’ or the ‘instrumental’ value of democracy, but it is unclear what this exactly means. Can democracy have other kinds of values? What does it mean to value democracy intrinsically? As a result, at certain points, scholars are talking past one another and their assessments of their (...) respective approaches to democracy are less clear than what they intended. This paper develops a conceptual framework of the values of democracy. I use this framework to classify theories of democracy under three main groups: theories that value democracy intrinsically, instrumentally, or contributorily (necessarily and non-necessarily). Through this analysis, the points of engagement among the different approaches will emerge and flawed arguments about democracy will be revealed. (shrink)

This essay frames systemic patterns of mental abuse against women of color and Indigenous women on Turtle Island (North America) in terms of larger design-of-distribution strategies in settler colonial societies, as these societies use various forms of social power to distribute, reproduce, and automate social inequalities (including public health precarities and mortality disadvantages) that skew socio-economic gain continuously toward white settler populations and their descendants. It departs from traditional studies in gender-based violence research that frame mental abuses such as gaslighting--commonly (...) understood as mental manipulation through lying or deceit--stochastically, as chance-driven interpersonal phenomena. Building on structural analyses of knowledge in political epistemology (Dotson 2012, Berenstain 2016), political theory (Davis and Ernst 2017), and Indigenous social theory (Tuck and Yang 2012), I develop the notion of cultural gaslighting to refer to the social and historical infrastructural support mechanisms that disproportionately produce abusive mental ambients in settler colonial cultures in order to further the ends of cultural genocide and dispossession. I conclude by proposing a social epidemiological account of gaslighting that a) highlights the public health harms of abusive ambients for minority populations, b) illuminates the hidden rules of social structure in settler colonial societies, and c) amplifies the corresponding need for structural reparations. This study examines the impact that research and development (R&D) intensity has on corporate social responsibility (CSR). We base our research on the resource-based view (RBV) theory, which contributes to our analysis of R&D intensity and CSR because this perspective explicitly recognizes the importance of intangible resources. Both R&D and CSR activities can create assets that provide firms with competitive advantage. Furthermore, the employment of such activities can improve the welfare of the community and satisfy stakeholder expectations, which might vary (...) according to their prevailing environment. As expressions of CSR and R&D vary throughout industries, we extend our research by analysing the impact that R&D intensity has on CSR across both manufacturing and non-manufacturing industries. Our results show that R&D intensity positively affects CSR and that this relationship is significant in manufacturing industries, while a non-significant result was obtained in non-manufacturing industries. Emotional facial expression are an important communication channel between artificial characters and their users. Humans are trained to perceive emotions. Robots and virtual agents can use them to make their inner states transparent. Literature reported that some emotional types, such as anger, are perceived as being more intense than others. Other studies indicated that gender influences the perception. Our study shows that once the individual differences amongst participants are included in the statistical analysis, then the emotion type has no further (...) explanatory power. From 17 to 22 October 1955, Madrid hosted the UNESCO Festival of Science. In the early years of the Cold War, in a dictatorial country that had recently been admitted into the international community, the festival aimed to spread science to the public through displays of scientific instruments, public lectures, book exhibitions, science writers professional associations, and debates about the use of different media. In this context, foreign visitors, many of whom came from liberal democracies, seemed comfortable in the capital (...) of a country ruled by a dictatorship that had survived after the defeat of fascism in the Second World War and was struggling to gain foreign recognition after years of isolation. This article analyzes the political role of science popularization in Madrid at that time. It approaches the apparently puzzling marriage between UNESCO’s international agenda for peace and democracy and the interests of the Francoist elites. Shared views of technocratic modernity, the fight against communism, and a diplomacy that served Spanish nationalism, paved the way for the alliance. (shrink)
